Refund & Cancellation Policy

Introduction

This Refund and Cancellation Policy governs all bookings made with Fishing With Stompie (“the Charter Operator”) for fishing charter services in South Africa. By making a booking, you (“the Customer”) agree to abide by these terms and conditions.

Definitions
  • Charter/Trip: The scheduled fishing excursion provided by the Charter Operator.
  • Booking: The reservation made by the Customer for a specific charter.
  • Payment: The initial payment required to secure the booking.
  • Cancellation: The Customer’s request to cancel the booked charter.
  • No-Show: Failure of the Customer to arrive or check-in at the designated meeting point by the scheduled departure time.

Booking and Payment
  • Payment is made in full to secure your charter seat
  • Payment may be made via credit and debit cards and all transactions will be conducted in South African Rands (ZAR).

Cancellation by the Customer

1. Cancellation Timeframes

  • More than [14] days before departure:
    • The Customer will receive a full refund of any payments made, minus any applicable administrative fee of 20%.
  • Between [7] and [14] days before departure:
    • The customer will receive 50% refund on payments made.
  • Less than [7] days before departure or No-Show:
    • No refund will be issued.

2. Cancellation Process

  • Cancellation requests must be submitted in writing (email or registered post) to [contact email/address]. fishingwithstompie@gmail.com or 64 Malvern Drive, Struisbaai, Western Cape 7825, South Africa
  • The date of receipt of the cancellation request will determine the applicable refund amount according to Section 4.1.

Cancellation or Rescheduling by the Charter Operator
  • In the event that the Charter Operator cancels the trip (e.g., due to adverse weather, mechanical issues, or other unforeseen circumstances beyond our control), the Customer will be offered:
    • A full refund of all payments made, or
    • The option to reschedule the charter at no additional cost.
  • Should rescheduling occur, any price differences for the new date will be communicated in advance.
Refund Procedures
  • Refunds will be processed using the same payment method originally used by the Customer.
  • All refunds (if applicable) will be processed within [specify number of days] working days following approval of the cancellation.
Rescheduling
  • The Customer may request to reschedule the charter instead of cancelling.
  • Rescheduling is subject to availability and must be confirmed by the Charter Operator.
  • Any payments made will be applied toward the rescheduled date; however, any rate changes (if applicable) will be the Customer’s responsibility.
Weather and Unforeseen Circumstances
  • Fishing charters are subject to weather and sea conditions. If unsafe conditions occur (as determined by the Captain), the charter may be cancelled.
  • In such cases, the Customer will be given the option to reschedule or obtain a full refund.
  • The Charter Operator’s decision regarding weather and safety is final.
Liability and Indemnity
  • The Customer acknowledges that fishing charters involve inherent risks. By booking a charter, the Customer agrees to release Fishing With Stompie and its employees from liability for any loss, damage, injury, or delay arising from the charter, except where caused by gross negligence or willful misconduct.
  • The Customer is responsible for following all safety instructions provided by the Captain and crew.
Amendments
  • Fishing With Stompie reserves the right to modify or amend this Refund and Cancellation Policy at any time. Updated policies will be posted on our website and communicated to Customers with existing bookings where possible.
Governing Law
  • This Policy and any disputes arising from it shall be governed by and construed in accordance with the laws of the Republic of South Africa.

By making a booking with Fishing With Stompie, the Customer acknowledges that they have read, understood, and agreed to be bound by the terms of this Refund and Cancellation Policy.
